&lt;p&gt;&lt;strong&gt;2. Berkeley races: &lt;/strong&gt;the Major political splits this year in Berkeley are developer giveaways, whether to further penalize the homeless &amp;amp; an well funded but under-reported attack on rent control. &lt;/p&gt;

&lt;div&gt;&lt;br/&gt;&lt;div&gt;&lt;u&gt; Rent Stabilization Board: &lt;/u&gt;Soto-Vigil, Shelton, Tregub, &amp;amp; Dodsworth. Tenants Rights are under attack in Berkeley from a faux tenant landlord funded slate for Berkeley Rent Board, TUFF. TUFF raised/spent $40,000 in four weeks, 97% of which was from big landlords and their lobbies. Vote just for the Tenants Convention Slate; SOTO-VIGIL, SHELTON, TREGUB, &amp;amp; DODSWORTH!!, they are the first two candidates, and the 5th &amp;amp; 6th candidates, Vote for the first two candidates, skip two candidates, then Vote the next Two Candidates. Protecting tenants rights is easy, VOTE TWO, SKIP TWO, VOTE TWO!&lt;br/&gt;&lt;br/&gt;*The progressive slate, was chosen at the Berkeley Tenant Convention by 200 tenants, homeowners, labor organizers, &amp;amp; a few small property owners. We will protect rent control, increase earthquake safety for everyone, bring fire safety to student tenements, expand composting &amp;amp; recycling to all multi-unit complexes, build on our growing outreach to Small Property owners and Tenants.&lt;br/&gt;&lt;br/&gt;&lt;u&gt;City Council District&lt;/u&gt;s&lt;/div&gt;
&lt;div&gt;City Council District 2: Denisha Delane #1, Adolfo Cabral #2, and no one else.&lt;br/&gt;City Council District 3: Max Anderson, and no one else.&lt;br/&gt;City Council District 5: Sophie Hahn, and no one else.&lt;br/&gt; City Council District 6: Unfortunately this is an uncontested race, proof Berkeley Activists need to organize. Don’t vote for Susan Wengraf, she thinks a successful referendum on a Developers Give away is &amp;#8220;Too Much Democracy!&amp;#8221; There is a Write candidate, if you want a protest vote Write in Phoebe Sorgen.&lt;/div&gt;
&lt;div&gt;&lt;br/&gt;&lt;u&gt;Mayor:&lt;/u&gt; Vote Kahlil Jacobs-Fantauzzi 1st Choice,  Kriss Worthington 2nd Choice, &amp;amp; 3rd Choice Jacquelyn McCormick. I&amp;#8217;m very glad that we have ranked-choice voting. I&amp;#8217;m voting for Kahlil number one, cause its a ranked choice race, and I want a Candidate with Local Roots to show a percentage in the race. I&amp;#8217;m voting for Kriss number two, he&amp;#8217;s the hardest working council person, and has mentored many young leaders. Jacquelyn is my Hail mary to beat Bates, though I distrust the anti tax rhetoric that comes from many of her followers I believe that us Liberals need to take stronger positions on fiscal accountability. No vote for Bates, he is out of touch with his own &amp;#8220;legacy.&amp;#8221;&lt;br/&gt; I ranked them 1. Kahlil, 2. Kriss, 3. McCormick&lt;br/&gt;&lt;br/&gt;&lt;u&gt;Berkeley School Board: &lt;/u&gt;vote for two, I&amp;#8217;m definitely voting for Judy Appel, she&amp;#8217;ll make Berkeley Schools far safer for LGBTQ youth. I&amp;#8217;m not sure who to place for my second candidate as I don&amp;#8217;t have much experience the school board issues, or race. I like both Tracy Hollander &amp;amp;  Beatriz Leyva-Cutler.&lt;br/&gt;&lt;br/&gt;&lt;u&gt;Berkeley Ballot Measures:&lt;/u&gt;&lt;/div&gt;
&lt;div&gt;Measure M: Yes  &amp;#8212;  Streets &amp;amp; water sheds, We should stop letting our infrastructure crumble.&lt;br/&gt;Measure N: Yes  — Pools bond. Yes,  It&amp;#8217;s a very inexpensive way to contribute meaningfully to public health.&lt;br/&gt; Measure O: Yes — Pool special tax. Funds Measure N. Yes&lt;br/&gt;Measure P: Yes  — Reauthorize taxes (Gann override). Yes&lt;br/&gt;Measure Q: Yes — Utility Users Fee Legal Language correction to close loop hole. &lt;br/&gt;Measure R: No — Redistricting. Vote No on Granting council the power to Jerry Mander the districts. &lt;br/&gt; Measure S: No  — Sit-lie ordinance. Vote No on ineffective criminalization of the homeless.&lt;br/&gt;Measure T&amp;#160;: No  — West Berkeley Project. Vote No on Developers Giveaways with out clear benefits, they must be negotiated together. Also breaks our Protections for Arts and craft, &amp;amp; light industrial zoning. &lt;br/&gt; Measure U: Yes — Sunshine Ordinance. Yes. It may be in some ways tougher then necessary, but council could have provided an stronger alternate; and without their compromise, I&amp;#8217;d rather have too much rather then too little transparency. We need open government!!&lt;br/&gt; Measure V: Yes  — Biennial Financial Reports, if not submitted, no tax increases (FACTS initiative). Yes&lt;/div&gt;

Oakland: &lt;/u&gt;Check &lt;a href="http://acgreens.files.wordpress.com/2008/09/greenvoterguidenov2012.pdf" target="_blank"&gt;Green Voter Guide&lt;/a&gt; they do some of the most in depth explanations of positions. &lt;br/&gt;&lt;div&gt;&lt;strong&gt;Rebecca Kalplan,&lt;/strong&gt; Oakland City Council At Large, never vote for De La Fuente&lt;br/&gt;D1: &lt;strong&gt;Donald Macleay #1&lt;/strong&gt; to encourage our third party candidates; &lt;strong&gt;Dan Kalb #2&lt;/strong&gt; he&amp;#8217;s our winner. &lt;/div&gt;
&lt;div&gt;D5: Mario Juarez, &lt;br/&gt;Assembly District 18. Abel Guillen&lt;/div&gt;
&lt;br/&gt;&lt;u&gt;5.  Albany: &lt;/u&gt;The Occupy The Farm movement this year injected a lot more energy to the campaigns &amp;amp; a lot more attention to development issues. I encourage voting for City Council (Sheri Spellwoman &amp;amp; Ulan McKnight) and School Board (Byron Barrett). Check the  Albany Patch &amp;amp; Green Voter Guide links for more info about the other candidates in those races.  ((this is a direct cut and past from Jesse Townley, he said it well)&lt;br/&gt;&lt;u&gt;&lt;br/&gt;6. Alameda County &amp;amp; Special Districts: &lt;/u&gt;&lt;br/&gt;&lt;div&gt;A1.  no position, Expands Oakland Zoo to do more wildlife rehabilitation!!! Into Knowland park protected area. I don&amp;#8217;t know enough about the issue to make a position. &lt;br/&gt; B1. YES YES YES!!! Public Transit Money we desperately  need!&lt;br/&gt;&lt;p class="MsoNormal"&gt;&lt;span&gt;AC TRANSIT AT LARGE:        &lt;strong&gt;Chris Peeples is Awesome, &lt;/strong&gt;though I disagree with him on the attempted implementation of BRT in Berkeley,&lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt; I think its his responsibility to advocate for exciting public transit models like BRT to make public transit more effective and therefor accessible. Additionally BRT lays the ground routes for future light rail. Furthermore I believe the blame for BRT not working with Berkeley&amp;#8217;s needs rests on Incumbent Mayor Bates shoulders. Bates I believe was interesting in railroading through a policy that justifies denser zoning, rather then defending the struggling Telegraph businesses. If you&amp;#8217;re railroading, there&amp;#8217;s no room for dialog and problem solving, &lt;strong&gt;&lt;br/&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;AC TRANSIT, WARD 1:   &lt;strong&gt;Joe Wallace &lt;/strong&gt; the incumbent is a transit dependent Richmond resident endorsed by Sierra Club, &amp;amp; Democratic Party of Alameda County. &lt;br/&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;BART BOARD, DISTRICT 3:         Rebecca Saltzman&lt;/span&gt;&lt;/p&gt;

&lt;p class="MsoNormal"&gt;&lt;span&gt;This election is critical not only for the future of our country but also for Berkeley’s future.&lt;/span&gt;&lt;/p&gt;


&lt;p class="MsoNormal"&gt;&lt;span&gt;Wall Street, corporations, and SuperPACs have spent millions trying to get Mitt Romney elected. Unfortunately in Berkeley, the bastion of liberal politics, the same is happening. Tens of thousands of dollars have been spent by large landlords and corporate interests in local races. Berkeley is at a crossroads and this is an election that will define the future of the City. Will we move in a direction of transformative change guided by the needs and values of our citizens, or will it be defined by politicians and corporate interests?&lt;/span&gt;&lt;/p&gt;


&lt;p class="MsoNormal"&gt;&lt;span&gt;This is what is at stake. So its no wonder landlords, real estate interests and business are spending so much bankrolling campaigns.&lt;/span&gt;&lt;/p&gt;


&lt;p class="MsoNormal"&gt;&lt;strong&gt;&lt;span&gt;Who are they backing?&lt;/span&gt;&lt;/strong&gt;&lt;span&gt; They’re backing a deceptively named slate called “Tenants United For Fairness”, who is really a pro-landlord slate (two of the candidates are landlords, and only one is a rent controlled tenant). They are running on a platform of attacking the Rent Board using a discredited Grand Jury Report, claiming something is wrong with how the Rent Board is being run. Their platform of lowering registration fees will result in less enforcement and pave the way for more evictions and rent increases. We saw what happened when a landlord slate took control of the Board in 1990 -  rents increased 33% in just one year! &lt;strong&gt;Big landlords and business interests have already pumped $40,000 into the TUFF slate &lt;/strong&gt;with the goal of electing candidates who will undermine important protections for renters.&lt;/span&gt;&lt;/p&gt;


&lt;p class="MsoNormal"&gt;&lt;strong&gt;&lt;span&gt;Big developers, landlords and corporations have also given thousands of dollars in contributions to support City Council candidates Laurie Capitelli and Darryl Moore &lt;/span&gt;&lt;/strong&gt;&lt;span&gt;and have supported two divisive ballot measures. Measure S, the proposed ban on sitting on commercial sidewalks has been bankrolled by over $100,000 in contributions from commercial landlords, developers and businesses.&lt;strong&gt;Measure S&lt;/strong&gt; would criminalize sitting on sidewalks, without providing any increase in shelter, services or Ambassadors.&lt;/span&gt;&lt;/p&gt;


&lt;p class="MsoNormal"&gt;&lt;strong&gt;&lt;span&gt;Measure T&lt;/span&gt;&lt;/strong&gt;&lt;span&gt;, the measure to rezone a large part of West Berkeley has been primarily funded by one developer who would like to change existing rules for his benefit. This illustrates what Measure T is all about - changing the rules allowing for out of scale development that will overwhelm Aquatic Park and harm existing residents and business - all for the benefit of a few corporate developers.&lt;/span&gt;&lt;/p&gt;



&lt;p class="MsoNormal"&gt;&lt;span&gt;We cannot let big business buy this election. We need to support candidates who will put the needs of residents first and defend Berkeley values. &lt;/span&gt;&lt;span&gt;Please support these candidates and measures when you cast your absentee ballot or at the polls next Tuesday. Franklin Delano Roosevelt was trying to get us health care 79 years ago way back in 1933 with the New Deal. Obamacare may have started as Heritagecare, the Proposal brought by the Heritage Foundation to undermine the Clinton&amp;#8217;s attempt to establish Single Payer Health Care 16 years before; But that was before Obama put caps on the profits Insurance Companies could charge, and extended the age for coverage for teenagers on their parents plans. If we re-elect Obama, and defend healthcare, Americans will begin to understand what we have and could have, and in four to eight years I think we&amp;#8217;ll successfully fight for Single Payer. &lt;/li&gt;
&lt;li&gt;&lt;strong&gt;If you live in a safe state, feel free to vote for a third party candidate as a protest,&lt;/strong&gt; I&amp;#8217;d encourage voting for Rosannarchy!! I think the greens should have picked Rosanne to bring attention to their party, which could have provided the momentum to elect greens to local offices. They had verbal permission to plant and landscape their back yard for years, but now their Landlord says he&amp;#8217;s sent a handyman to cut down their plants. However they&amp;#8217;ve been doing this with at least five years of documentation. It would be better if it was specifically included in their lease or in written communication by letter or email, but their photo documentation, with their notes and Medical Marijuana Scripts should be enough to assert their verbally contracted right to landscape their yard as they choose.&lt;/p&gt;
&lt;p&gt;In searching for advice I found that the Berkeley Rent Board might need to bone up on Medical Marijuana Law or find good Marijuana law advocates to refer their clients to. My constituent was dismayed by her first contact with a Berkeley Rent Board counselor who told her that she was breaking the law and had no rights. My constituent was upset, but knew better, and took a breather then called back and asked to speak with a different counselor. This counselor was very tentative, but did inform my constituent that if she had a right to garden, that the Landlord had no right to dig up or cut down her plants. This is closer to my understanding of the law, and upon consulting with different tenant advocates I confirmed to the best of my ability that: medical marijuana is legal in Berkeley; a tenant who has right to garden his/her yard can grow up to the legal quantity of Medical Marijuana proscribed by local law; that local, state, &amp;amp; federal police are not interfering with patients growing their own legal quantity of medically proscribed marijuana; that tenant at times have had to bill their landlords for damage done by handymen to there gardens; and that tenants with landlords interfering in their right to legally grow should consult with Medical Marijuana Advocates.&lt;/p&gt;
&lt;p&gt;Medical Patient be warned, there are landlord attorney&amp;#8217;s who assert that there is no legal right to grow marijuana as it is a federal crime. These are they type of Lawyer that might encourage Landlords to take actions the skirt the law, or find other ways to criminalize their tenants. Though the only ones I&amp;#8217;ve seen speak to this matter, caution their potential clients to not waste time on simply smoking a joint. That a successful Marijuana prosecution will likely be based on establishing in the eyes of the law, that what is in fact happening is a nuisance, and or drug dealing. &lt;/p&gt;

&lt;div&gt;be moved to a larger room when a controversial proposal is likely to&lt;/div&gt;
&lt;div&gt;attract a&lt;/div&gt;
&lt;div&gt;large crowd. This will reduce the frustration factor of people forced to&lt;/div&gt;
&lt;div&gt;wait outside or in the hallways. People with children, people with jobs&lt;/div&gt;
&lt;div&gt;the next morning, and disabled residents will be less likely to give up&lt;/div&gt;
&lt;div&gt;and go home. Any small cost for live television broadcasting is worth it&lt;/div&gt;
&lt;div&gt;to promote democratic participation.&lt;/div&gt;
&lt;div&gt;2.&lt;span&gt;        &lt;/span&gt;MORE MEETINGS ORGANIZED MORE EFFECTIVELY: Planning Department&lt;/div&gt;
&lt;div&gt;Public Hearings on ZAB appeals should be scheduled at special meetings&lt;/div&gt;
&lt;div&gt;with&lt;/div&gt;
&lt;div&gt;nothing else on the agenda.&lt;span&gt;  &lt;/span&gt;Staff and management from other departments&lt;/div&gt;
&lt;div&gt;should not be subjected to hours of unnecessary delay. The number of City&lt;/div&gt;
&lt;div&gt;Council meetings per year has been decreased. The convenience of hundreds&lt;/div&gt;
&lt;div&gt;of members of the public is more important than the convenience of nine&lt;/div&gt;
&lt;div&gt;City Council members. Increasing the number of Council meetings to what&lt;/div&gt;
&lt;div&gt;they used to be is not an unreasonable burden.&lt;/div&gt;
&lt;div&gt;3.&lt;span&gt;        &lt;/span&gt;PARLIAMENTARIAN: when a Councilmember (or anyone else) insults&lt;/div&gt;
&lt;div&gt;other Council members, the Chair or a designated Parliamentarian should&lt;/div&gt;
&lt;div&gt;point out this is not the place for such behavior. Max Anderson defended&lt;/div&gt;
&lt;div&gt;himself, but the chair should have intervened promptly.&lt;/div&gt;
&lt;div&gt;4.&lt;span&gt;        &lt;/span&gt;EQUAL TREATMENT FOR THE PUBLIC: Speakers should not have arbitrary&lt;/div&gt;
&lt;div&gt;requirements made up on the spot limiting their ability to speak, and the&lt;/div&gt;
&lt;div&gt;rules should be enforced fairly.&lt;/div&gt;
&lt;div&gt;5.&lt;span&gt;        &lt;/span&gt;POSTING UPDATED AGENDA LIST:&lt;span&gt;  &lt;/span&gt;It is difficult for the public in&lt;/div&gt;
&lt;div&gt;the room or on tv to know what items have been completed, and what items&lt;/div&gt;
&lt;div&gt;are&lt;/div&gt;
&lt;div&gt;left to be discussed. Items are added to or removed from the Consent&lt;/div&gt;
&lt;div&gt;Calendar or withdrawn or postponed but it happens so quickly that the&lt;/div&gt;
&lt;div&gt;public may be sitting there waiting for the item for hours. After the&lt;/div&gt;
&lt;div&gt;Consent Calendar is voted on, a list of remaining items could be posted in&lt;/div&gt;
&lt;div&gt;the room and given to the television broadcasters.&lt;/div&gt;
&lt;div&gt;6.&lt;span&gt;        &lt;/span&gt;DIVERSITY: The splendid diversity of our City should be&lt;/div&gt;
&lt;div&gt;reflected in who gets appointed to City Commissions. The Mayor has been&lt;/div&gt;
&lt;div&gt;elected&lt;/div&gt;
&lt;div&gt;citywide for ten years, but every diversity study shows a lack of fair&lt;/div&gt;
&lt;div&gt;representation of Asian, Latino and/or African American commissioners in&lt;/div&gt;
&lt;div&gt;who he has appointed. Out of thirty four possible appointees, there are&lt;/div&gt;
&lt;div&gt;many talented people of all races qualified to be Commissioners.&lt;/div&gt;
&lt;div&gt;7.&lt;span&gt;        &lt;/span&gt;PROFESSIONAL SUPERVISION: The City Council should conduct an&lt;/div&gt;
&lt;div&gt;annual evaluation of the City Manager. This has only happened a few times&lt;/div&gt;
&lt;div&gt;in the past ten years. It is an important step to provide praise as well&lt;/div&gt;
&lt;div&gt;as&lt;/div&gt;
&lt;div&gt;feedback. In some ways it is the most important job of the Mayor and City&lt;/div&gt;
&lt;div&gt;Council and it is being neglected year after year.&lt;/div&gt;
&lt;div&gt;&lt;/div&gt;
&lt;div&gt;8.&lt;span&gt;        &lt;/span&gt;FISCAL RESPONSIBILITY:&lt;span&gt;  &lt;/span&gt;If the City Manager were to be fired for&lt;/div&gt;
&lt;div&gt;horrible job performance, they would still receive a one year severance&lt;/div&gt;
&lt;div&gt;package of almost a quarter of a million dollars. This is not an incentive&lt;/div&gt;
&lt;div&gt;for good performance. It is also the wrong message to send to the social&lt;/div&gt;
&lt;div&gt;service programs that have suffered painful cuts, and employees who have&lt;/div&gt;
&lt;div&gt;been laid off or sacrificing to save the City money by taking unpaid VTO&lt;/div&gt;
&lt;div&gt;(voluntary time off) days.&lt;/div&gt;
&lt;div&gt;9.&lt;span&gt;        &lt;/span&gt;NOT JUST TRICKLE-DOWN DEVELOPMENT: If you have not participated&lt;/div&gt;
&lt;div&gt;in a development debate you probably think Berkeley is on the right track.&lt;/div&gt;
&lt;div&gt;Many hundreds of residents who have encountered a neighborhood development&lt;/div&gt;
&lt;div&gt;issue become frustrated with the incumbent’s starting point that benefits&lt;/div&gt;
&lt;div&gt;automatically trickle down from development. In reality, development that&lt;/div&gt;
&lt;div&gt;pays its fair share can be great, but development which fails to pay for&lt;/div&gt;
&lt;div&gt;fair labor policies, parking, traffic impacts, affordable housing and open&lt;/div&gt;
&lt;div&gt;space can be very problematic.&lt;/div&gt;
&lt;div&gt;10.&lt;span&gt;        &lt;/span&gt;COST-EFFECTIVE PROGRESSIVE POLICY: Many other City Councils have&lt;/div&gt;
&lt;div&gt;eclipsed Berkeley in adopting practical progressive policy.&lt;span&gt;  &lt;/span&gt;Graduate and&lt;/div&gt;
&lt;div&gt;undergraduate students have numerous innovative ideas, but are denied&lt;/div&gt;
&lt;div&gt;their seat at the table. When we adopted the Climate Action plan, with&lt;/div&gt;
&lt;div&gt;hundreds of possible implementation policies, I repeatedly requested a&lt;/div&gt;
&lt;div&gt;cost effective analysis of what actions would contribute to the most&lt;/div&gt;
&lt;div&gt;greenhouse gas reduction.&lt;span&gt;  &lt;/span&gt;City actions have not achieved significant&lt;/div&gt;
&lt;div&gt;greenhouse gas reductions, in part because we have yet to receive that&lt;/div&gt;
&lt;div&gt;analysis and therefore are not prioritizing cost effective strategies.&lt;/div&gt;
&lt;div&gt;&lt;/div&gt;
&lt;div&gt;Please consider these and numerous other ideas I will introduce during the&lt;/div&gt;
&lt;div&gt;candidate forums. Public policy is more important than personalities and&lt;/div&gt;
&lt;div&gt;politics. I am running for Mayor to have a platform to alert people to&lt;/div&gt;
&lt;div&gt;what is happening and to advocate common sense solutions.&lt;/div&gt;
&lt;div&gt;&lt;/div&gt;
&lt;div&gt;Berkeley attracts a talented team of City Staff, Department Heads and City&lt;/div&gt;
&lt;div&gt;Management, then we subject them, and the public, to poorly organized&lt;/div&gt;
&lt;div&gt;Council meetings that waste their time and leave them tired for the next&lt;/div&gt;

&lt;div&gt;social issues. We can do more to channel their enthusiasm into a dazzling&lt;/div&gt;
&lt;div&gt;display of democracy in action, if we make some positive practical&lt;/div&gt;
&lt;div&gt;changes.&lt;/div&gt;

&lt;div&gt;Some say this is a David and Goliath battle where the incumbent will have&lt;/div&gt;
&lt;div&gt;overwhelming money from corporate developers. Many will be afraid to stand&lt;/div&gt;
&lt;div&gt;up against the “machine”. Still others fondly remember their former&lt;/div&gt;
&lt;div&gt;Assembly member and are unaware of current issues.&lt;/div&gt;
&lt;div&gt;As I walk and talk with residents of Berkeley I hear again and again that&lt;/div&gt;
&lt;div&gt;they want a choice.&lt;span&gt;  &lt;/span&gt;I run to offer ideas, and an alternative choice.&lt;/div&gt;

I&amp;#8217;m now very curious about the Civil Grand Jury process, as their critiques of the rent board are simplistic, lack citation of relevant data, and suggest a Bias. I should be clear here, I sit on the Berkeley Rent Board, but the processes they critique were established long before I was elected, so they aren&amp;#8217;t a critique of policies I&amp;#8217;ve enacted. That being said, I&amp;#8217;m disappointed at their apparent limited ability to understand a semi complex issues. &lt;br/&gt;&lt;br/&gt;For example they state the BRSB registration fee&amp;#8217;s are unfairly high, and to prove this the compare BRSB&amp;#8217;s fee&amp;#8217;s to very different rent controlled jurisdictions. Different types of jurisdictions produce very different effective regulation of the landlord tenant relationship. In 1980 Berkeley voters chose an enforcement driven Rent Stabilization Ordinance, yet the cities they compared us too chose complaint driven ordinances. Outreach &amp;amp; Enforcement driven dept&amp;#8217;s like Berkeley, East Palo Alto and Santa Monica&amp;#8217;s require higher registration fee&amp;#8217;s fund($150-$194), yet yield higher success rates. And the proof is in the pudding, only 5% of Berkeley tenants pay illegally high rents, Where as in complaint driven municipalities like Los Angeles 25% of tenants are paying illegally high rents.&lt;/p&gt;

&lt;p&gt;Fortunately for myself I’m not a cop, cause if I was I’d be one of those officers “accidentally” shot by another cop during a routine traffic stop; or thrown in an insane asylum like the NYPD officer who taped and proved to the public that the Dept was using quotas and under reporting crimes to juke the stats. And if I was fortunate enough to be a lucky “good cop” and escaped execution, I’d still get punished &amp;amp; fired: like the rookie that exposed West Oakland’s Criminal Cop Gang “the Riders,” he didn&amp;#8217;t last a year; or I’d get demoted and then fired like Oakland’s Community Policing Lt. who was followed Community Oriented Policing Policy when he began sharing real police statistics with his crime watch groups.&lt;/p&gt;

&lt;p&gt;&lt;a href="http://www.letsgetfreethebook.com/aboutpaulbutler.html"&gt;&lt;img align="left" height="144" src="http://www.letsgetfreethebook.com/images/main-left-butler.jpg" width="112"/&gt;&lt;/a&gt;IF you are ever on a jury in a marijuana case, I recommend that you vote  “not guilty” — even if you think the defendant actually smoked pot, or  sold it to another consenting adult. As a juror, you have this power  under the Bill of Rights; if you exercise it, you become part of a proud  tradition of American jurors who helped make our laws fairer.&lt;/p&gt;
&lt;p&gt;The information I have just provided — about a constitutional doctrine  called “jury nullification” — is absolutely true. But if federal  prosecutors in New York get their way, telling the truth to potential  jurors could result in a six-month prison sentence.&lt;/p&gt;
&lt;p&gt;Earlier this year, prosecutors &lt;a href="http://www.nytimes.com/2011/02/26/nyregion/26jury.html"&gt;charged&lt;/a&gt; Julian P. Heicklen, a retired chemistry professor, with jury tampering  because he stood outside the federal courthouse in Manhattan providing  information about jury nullification to passers-by. Given that I have  been recommending nullification for nonviolent drug cases since 1995 —  in such forums as The Yale Law Journal, “60 Minutes” and YouTube — I  guess I, too, have committed a crime.&lt;/p&gt;
&lt;p&gt;The prosecutors who charged Mr. Heicklen &lt;a href="http://www.nytimes.com/2011/11/28/nyregion/brief-details-jury-nullification-case-against-julian-heicklen.html"&gt;said that&lt;/a&gt; “advocacy of jury nullification, directed as it is to jurors, would be  both criminal and without constitutional protections no matter where it  occurred.” The prosecutors in this case are wrong. The First Amendment  exists to protect speech like this — honest information that the  government prefers citizens not know.&lt;/p&gt;
&lt;p&gt;Laws against jury tampering are intended to deter people from  threatening or intimidating jurors. To contort these laws to justify  punishing Mr. Heicklen, whose court-appointed counsel describe him as “a  shabby old man distributing his silly leaflets from the sidewalk  outside a courthouse,” is not only unconstitutional but unpatriotic.  Jury nullification is not new; its proponents have included John Hancock  and John Adams.&lt;/p&gt;
&lt;p&gt;The doctrine is premised on the idea that ordinary citizens, not  government officials, should have the final say as to whether a person  should be punished. As Adams put it, it is each juror’s “duty” to vote  based on his or her “own best understanding, judgment and conscience,  though in direct opposition to the direction of the court.”&lt;/p&gt;
&lt;p&gt;In 1895, the Supreme Court ruled that jurors had no right, during  trials, to be told about nullification. The court did not say that  jurors didn’t have the power, or that they couldn’t be told about it,  but only that judges were not required to instruct them on it during a  trial. Since then, it’s been up to scholars like me, and activists like  Mr. Heicklen, to get the word out.&lt;/p&gt;
&lt;p&gt;Nullification has been credited with helping to end alcohol prohibition  and laws that criminalized gay sex. Last year, Montana prosecutors were  forced to offer a defendant in a marijuana case a favorable plea bargain  after so &lt;a href="http://www.huffingtonpost.com/2010/12/22/montana-jury-marijuana-mutiny_n_800074.html"&gt;*many potential jurors said they would nullify&lt;/a&gt; that the judge  didn’t think he could find enough jurors to hear the case. (Prosecutors  now say they will remember the actions of those jurors when they  consider whether to charge other people with marijuana crimes.)&lt;/p&gt;

&lt;p&gt;&lt;em&gt;Commentary: The Author Paul Butler then wrote a disclaimer here about the use of Jury nullification by all white Juries who would refuse to convict Klansmen for their hate crimes against African Americans.. But these cases happened in the times of the landmark &lt;a href="https://en.wikipedia.org/wiki/Plessy_v._Ferguson" title="Plessy v. Ferguson"&gt;1896&amp;#160;&lt;/a&gt;&lt;a href="https://en.wikipedia.org/wiki/Plessy_v._Ferguson" title="Plessy v. Ferguson"&gt;Plessy v. Ferguson&lt;/a&gt; Supreme Court Decision, which enshrined Jim Crow Segregation with &amp;#8220;Constitutional Protection,&amp;#8221; They happened at a time Amerika cherished segregated Court Houses &amp;amp;Juries, African Americans could only watch court proceedings from separate galley. These Segregated, ie All White Male Juries were standing in judgement of communities that had a super majority of African Americans, in the 80 &amp;amp; 90 percentiles .. The Juries shouldn&amp;#8217;t have been all white, they should have been all black. Mr. Butler&amp;#8217;s comments are included here with strike through.&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;&lt;del&gt;There have been unfortunate instances of nullification. Racist juries in  the South, for example, refused to convict people who committed violent  acts against civil-rights activists, and nullification has been used in  cases involving the use of excessive force by the police. But  nullification is like any other democratic power; some people may try to  misuse it, but that does not mean it should be taken away from everyone  else.&lt;/del&gt;&lt;/p&gt;
&lt;/blockquote&gt;
&lt;p&gt;How one feels about jury nullification ultimately depends on how much  confidence one has in the jury system. Based on my experience, I trust  jurors a lot. I first became interested in nullification when I  prosecuted low-level drug crimes in Washington in 1990. Jurors here, who  were predominantly African-American, nullified regularly because they  were concerned about racially selective enforcement of the law.&lt;/p&gt;
&lt;p&gt;Across the country, crime has fallen, but incarceration rates remain at  near record levels. Last year, the New York City police made &lt;a href="http://www.newsday.com/long-island/crime/at-50-000-pot-busts-lead-arrests-in-nyc-1.3299297"&gt;50,000 arrests&lt;/a&gt; just for marijuana possession. Because prosecutors have discretion over  whether to charge a suspect, and for what offense, they have more power  than judges over the outcome of a case. They tend to throw the book at  defendants, to compel them to plead guilty in return for less harsh  sentences. In some jurisdictions, like Washington, prosecutors have  responded to jurors who are fed up with their draconian tactics by  lobbying lawmakers to take away the right to a jury trial in drug cases.  That is precisely the kind of power grab that the Constitution’s  framers were so concerned about.&lt;/p&gt;
&lt;p&gt;In October, the Supreme Court justice Antonin Scalia, asked at a Senate  hearing about the role of juries in checking governmental power, seemed  open to the notion that jurors “can ignore the law” if the law “is  producing a terrible result.” He added: “I’m a big fan of the jury.” I’m  a big fan, too. I would respectfully suggest that if the prosecutors in  New York bring fair cases, they won’t have to worry about jury  nullification. Dropping the case against Mr. Heicklen would let citizens  know that they are as committed to justice, and to free speech, as they  are to locking people up.&lt;/p&gt;

Tags identify the subject(s) of a  post. They started on Youtube to help people sort through all the videos  people posted. Tags are anarchistic in that no one controls them, they  are a reflection of their usage. If I run across a tag I don&amp;#8217;t  understand, I look it up on  TagDef, if the y don&amp;#8217;t have a definition, I  google it, &lt;/span&gt;&lt;span class="author-g-k0mulnerued9kwwk url"&gt;&lt;a href="http://tagdef.com/"&gt;&lt;a href="http://TagDef.com"&gt;http://TagDef.com&lt;/a&gt;&lt;/a&gt;&lt;/span&gt;&lt;span class="author-g-k0mulnerued9kwwk"&gt; . Bike Karts if you got them are a great way to pack gear if your going with friends, but a shopping cart might work.
